Kane County Burning Regulations

Definitions

“LANDSCAPE WASTE" means all accumulations of grass or shrubbery cuttings, leaves, flowers and weeds.

“BRUSH" means tree trunks, limbs, branches and twigs.  

For Unincorporated Areas of the County with these Zip Codes:

60102, 60110, 60118, 60120, 60121, 60123, 60124, 60134, 60136, 60170, 60174, 60175, 60177, 60183, 60184, 60185, 60504, 60505, 60506, 60507, 60510, 60538, 60542​

Burning of “Landscape Waste" is prohibited at any time. “Brush" may be burned when following the Standard Restrictions below.

The burning of any materials besides “Brush" is prohibited and punishable.

​For Unincorporated Areas of the County with these Zip Codes:

60109, 60119, 60140, 60142, 60144, 60147, 60151, 60178, 60182, 60511, 60554, 

Burning of dry landscape waste and/or brush is currently permitted, subject to the Standard Restrictions.

The burning of any materials besides “Landscape Waste and Brush" is prohibited and punishable.​

Standard Restrictions (These apply to all zip codes) 

  • Only on the property upon which the landscape waste or brush was generated
  • Only on sunny days from 10:00 am to 3:00 pm 
  • Cannot be larger than 6'x6'x6' 
  • Not when wind exceeds 10mph
  • Not within 20 feet of any building, structure, or property line 
  • Not during announced inversion conditions or ozone alerts 
  • Any burning must be supervised until the fire is extinguished; a fire extinguisher; garden hose or water source must be available at the burning site 

 

Exemptions

1. Any property zoned and used for agricultural purposes. Burning of garbage and/or other hazardous materials or chemicals is prohibited regardless of exemptions.  (These properties fall under the IL State Laws.)

2. Burning for the purpose of prairie restoration or firefighter training

3. Burning of brush in fire places and self-contained outdoor wood burning devices

4. Burning of brush for recreational fires, but the fire cannot be larger than 3'x3'x3' 5. Ceremonial fires for a scheduled public or private event. Notice must be given to the local fire department, and a permit is required.  


​Penalties

A fine up to $500 shall punish any person who violates any provision.
